Can a business simply build a gym right underneath my flat?

Appreciate this might not fall under the intended purpose of this forum but would like to take advantage of others' experience.

I rent a flat. Downstairs, a property downstairs used to be a retail shop. It has been done up as a gym. The noise you would associate with gym classes is wild and completely unacceptable. It's right underneath three residential properties. Previous landlord has sold it on and scarpered.

Isn't there something called planning permission meant for these things? If there is, what could be the outcome? If not, er why not?

Retail shops and gyms fall under the same Use Class, Class E and so you can use one or the other without Planning.

However, a shop mostly selling essential goods, including food, to visiting members of the public in circumstances where—
(i) the shop’s premises cover an area not more than 280 metres square, and
(ii) there is no other such facility within 1,000 metre radius of the shop’s location would fall under Class F2. Therefore, a small shop that changes to a gym would require Planning.
