Decking extending from pre-existing steps

Hi,
I understand decking can be installed without PP if not over 30cm from the ground and at the back of the property.

We are interested in a domestic property and it has decking that has been put in at the original level the steps start to go down into the garden (garden slopes away from the house). The original steps go down about 3 foot into the garden and are under the decking. The decking is level with the first step and extends out level by nearly twice the width the original steps were and also to the side where steps weren’t.

There is also a balustrade around the decking with glass panels which is about 4 feet tall.

We’ve asked the seller if planning permission was sought / granted (installed less than 2 years ago) and they have said it wasn’t needed as it is at the same height of the top step was originally used.

Are they correct? Would we need to get retrospective PP?

Over 300mm requires Planning. Up you if you want to seek retrospective Planning. The limit of enforcement is now 10 years.
