Hi
Are all charity trustees to be given notice When an applicant gives 21 days notice of a planning application, as I understand that as trustees they have ownership rights over the land. The applicant in this case only sent the notice to the clerk to the trustees( using an incorrect postcode). Does he have to give notice to all trustees individually?

It is a legal requirement that owners of land upon which a planning application is being made are notified of that application. The term “owner” means a person having a freehold interest or a leasehold interest the unexpired term of which is not less than seven years. There can therefore be more than one owner (for example, the landlord and any tenants). When the landowner has been notified by the applicant, the applicant is required to confirm this to the

Thanks. I was aware of this, but I wondered if anyone knew whether”owners” also meant trustees, and thereby meaning the “Article 12” certificate has to be sent to each of them. The applicant in question has just sent it to the clerk to the trustees, who would be prohibited from acting alone, eg what if she decided to sell the land as a trustee without telling the rest? I feel tthey all have to be told but need to check before I challenge the certificate as incorrect.

An email to the Planning department would quickly clarify that.
