Raised Decking

Looking for some advice please !

We purchased our house in November 2009 with raised decking at the front and side covering a fairly large area where the ground falls away as the house is built into a slope (2 storeys at the front but 3 storeys at the back).

In April 2012 a complaint was made to planning enforcement about the raised decking. Fortunately the estate agent who had marketed the property for the previous owners was able to evidence the fact that the decking had been in place since at least October 2007 ie 12 months before the planning requirement for raised decking was introduced, and over 4 years before the planning complaint was raised.

The enforcement case was closed with the decision 'Permitted Development' and although we considered obtaining a lawful development certificate at the time we never got round to it.

11 years later the decking is now in a sorry state and in need of significant refurbishment, possibly including the supporting framework.

We are now unsure whether we can commence work to repair (or worst case scenario, replace like-for-like) the raised decking on the strength of the outcome of the planning enforcement case or if we need to apply for a lawful development certificate.

Can anyone offer advice please ?

Replacement is treated as new. So the new decking would need to meet PD or Planning policies.
