Replacing existing porch

Question re permitted development for porches. If I'm just taking down a current porch and replacing it with a better one (less than 3 mt high and less than 3 mt wide externally) does it matter that it almost goes directly onto the pavement not to 2 mt specified for new ones as its already there? thanks
